Offering of services is conditional on availability and prevailing weather conditions. We retain the authority to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Should you wish to reserve a charter, you are required to:
- Have reached the age of majority, which is 18 years
- Submit accurate and comprehensive details
- Provide the deposit as noted in your reservation confirmation
- Accept and adhere to these Terms & Conditions
3.2 Confirmation
A charter booking is considered confirmed only after we have received your payment and sent you written confirmation. We hold the discretion to decline service to any individual.
3.3 Availability
The availability of charters is contingent upon vessel accessibility and advantageous weather conditions. We will make all reasonable attempts to meet your requested dates and times.
4. Payment Terms
4.1 Pricing
Pricing is indicated in € and encompasses any relevant taxes, unless stated otherwise. Note that prices may shift without prior notification.
4.2 Payment Schedule
- Initial Deposit: Payment of 50% of the total cost of the charter is required at the time of reservation
- Final Balance: Must be paid no later than 48 hours before the charter is due to start
- Incidental charges (if any): These are payable upon the charter's conclusion
4.3 Payment Methods
We accept a variety of payment methodologies, including major credit cards, wire transfers, and certified bank drafts. All payments are processed securely with encryption.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours prior to departure: A refund is processed, less any transaction charges
- Between 24 and 72 hours before departure: A refund equivalent to half of the total amount
- Less than 24 hours prior to departure: No opportunity for a refund exists
5.2 Weather Cancellations
In instances where the captain deems weather to constitute a danger, we will propose the following:
- Arrange a new date for your charter without any further costs
- Extend a full repayment if a reschedule is unachievable
5.3 Mechanical Issues
In the event that there are mechanical difficulties with the designated vessel, efforts to provide a substitute will be made. If this is not possible, we will return your complete payment.
6. Safety and Conduct
6.1 Safety Requirements
It is mandatory for all passengers to:
- Heed all instructions given by the crew
- Use provided safety gear as needed
- Disclose any health conditions that may impact their security
- Stay within the authorized areas on the vessel
6.2 Prohibited Items
The possession of certain items on board is strictly forbidden:
- Glass receptacles
- Banned substances
- Weapons of any form
- Excessive amounts of beverages (aside from moderate non-alcoholic drinks like juice or soda)
- Pets, unless we have given our consent in advance
6.3 Conduct
Passenger behavior must remain courteous at all times. Should personal conduct threaten safety or infringe upon the enjoyment of others, the charter may be terminated prematurely without reimbursement.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the fee paid for your charter. We are not accountable for:
- Injuries to persons resulting from their own carelessness
- Damage or loss of personal items
- Indirect damages, consequential losses, or penal damages
- Delays due to weather or events beyond our sphere of influence
7.2 Insurance Coverage
Comprehensive marine insurance that covers both our fleet and business operations is in place. It is the responsibility of passengers to secure their own insurance for travel and personal belongings.
7.3 Assumption of Risk
Engaging in our charter offerings signifies comprehension that maritime pursuits carry inherent dangers, with participants taking responsibility for their own safety and security.
8. Modifications and Itinerary Changes
We maintain the authority to adjust itineraries, paths, or schedules in response to elements such as weather conditions, safety concerns, or logistical requisites. Efforts to ensure experiences of comparable value will be made wherever possible.
9. Force Majeure
Occurrences that lie outside our sphere of control, including but not restricted to the following, do not render us liable for postponements, cancellations, or modifications:
- Extremely adverse weather scenarios
- Catastrophic events of nature
- Government-imposed edicts
- Closures mandated by port authorities
- Mechanical failures beyond our anticipation
